DRIVING UNDER THE INFLUENCE OF ALCOHOL/DRUGS (DWI/DUI)
New Jersey DWI (Driving While Intoxicated) or DUI (Driving Under the Influence) arrests are very serious matters. The penalties for a conviction can be devastating. The license suspension alone can last for several months or years in some cases.
Each conviction can result in jail time – up to 30 days for a first offense, up to 90 days for a second offense, and mandatory 180 days for a third offense.
Under New Jersey’s DWI/DUI law, a violation for DWI/DUI occurs when a person operates a motor vehicle while under the influence of alcohol, drugs or a combination of both. New Jersey’s drunk driving statute, N.J.S.A. 39:4-50, provides that a violation occurs when a person “…operates a motor vehicle while under the influence of intoxicating liquor, narcotic, hallucinogenic or habit-producing drug, or operates a motor vehicle with a blood alcohol concentration of 0.08% or more by weight of alcohol in the defendant’s blood …”
You can be convicted of DWI/DUI based on a police officer’s observation of behavior and performance of field sobriety tests, statements made to an officer, results of breath testing, laboratory analysis of blood or urine, and testimony from police officers trained to recognize impairment from drugs (Drug Recognition Experts.) You may be given a ticket for DWI/DUI even if your blood alcohol content (BAC) is below the legal limit of .08% BAC.
