Your child does not have to answer questions asked by the police. Probable Cause Prior to Search and Seizure 

Law enforcement officials cannot search a minor’s person or property without probable cause. If a search is conducted without permission, probable cause, or a warrant, evidence obtained in the search may be thrown out. 

Avoid Self-Incrimination 

Juveniles have the right to “plead the 5th” and avoid answering any questions that may potentially incriminate themselves. 

A Phone Call 

Juvenile offenders are also allowed the right to a phone call. While adults are typically allowed just one, a juvenile may be allowed to reach out multiple times or to multiple numbers if they’re not able to reach an adult who can help them. An officer of the law cannot deny a minor the right to contact a parent or guardian to handle the situation. 

Legal Counsel 

A child also has the right to speak with legal counsel, whether or not their parent or guardian contacts the attorney or not. If a child is detained and requests to consult with an attorney, one must be provided to them.
